HomelyVend is an e-commerce platform specialising in the sale of home appliances. We offer both outright purchase and flexible installment payment options to make quality home appliances accessible to our customers.

By using our website, you represent and warrant that:

• You are at least 18 years of age
• You have the full legal capacity to enter into a binding contractual agreement
• All information you provide to us is accurate, current, and complete
• You are not barred or restricted from using our services under applicable Nigerian law

• All products listed on the website are subject to availability. HomelyVend reserves the right to limit quantities or discontinue products at any time
• All prices are displayed in Nigerian Naira (₦) and may change without prior notice
• We reserve the right to correct any pricing errors at any time, including after an order has been placed. In such cases, we will notify you and give you the option to proceed at the correct price or cancel your order

Orders are confirmed only upon receipt of full payment or the agreed initial deposit for installment plans. HomelyVend offers the following payment options:

• Full upfront payment; or
• Approved installment payment plans (see Section 5 for full installment terms)

We reserve the right to decline or cancel any order at our discretion. If a payment is received for a cancelled order, a full refund will be issued.

• HomelyVend delivers within Lagos and to other parts of Nigeria. Delivery timelines vary depending on the customer's location and will be communicated at the time of order confirmation
• Customers must provide accurate and complete delivery details. HomelyVend shall not be liable for failed or delayed deliveries resulting from inaccurate information provided by the customer
• Additional delivery fees may apply based on location and will be disclosed before order confirmation
• HomelyVend shall not be liable for delivery delays caused by circumstances beyond our reasonable control, including adverse weather, traffic disruptions, or actions by third-party logistics providers

• Customers may return a product within seven (7) days of delivery if the product is defective or was damaged upon delivery
• To be eligible for a return, the product must be unused and in its original packaging, with all accessories and documentation included
• To initiate a return, the customer must contact HomelyVend via email or WhatsApp within the 7-day window, providing proof of purchase and a description of the defect or damage
• Upon receipt and inspection of the returned product, HomelyVend will notify the customer of the outcome. If the return is approved, a refund will be processed within 7–14 business days
• The cost of return delivery shall be borne by HomelyVend where the defect or damage is confirmed. If the return is not approved, the product will be returned to the customer at their own cost
• Delivery fees paid at the time of purchase are non-refundable

• Some products sold on HomelyVend may be covered by a manufacturer's warranty. Any such warranty will be stated in the product listing
• Warranty claims must be made in accordance with the relevant manufacturer's guidelines. HomelyVend will assist customers in facilitating warranty claims where possible
• HomelyVend is not responsible for defects or damages arising from misuse, negligence, improper installation, unauthorised modifications, or failure to follow product instructions

By using our website, you agree that you will not:

• Use the website for any unlawful, fraudulent, or harmful purpose
• Provide false, misleading, or incomplete information at any stage of a transaction
• Attempt to interfere with the security, integrity, or proper functioning of the website
• Engage in any conduct that damages the reputation of HomelyVend
• Use any automated means to access or scrape content from the website without our prior written consent

All content on this website, including but not limited to logos, images, text, product descriptions, and designs, is the exclusive property of HomelyVend or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or use any such content without our prior written permission.

To the fullest extent permitted by applicable law, HomelyVend shall not be liable for:

• Any indirect, incidental, special, or consequential loss or damage arising from your use of our website or services
• Loss of data, income, or goodwill
• Delivery delays caused by events outside our reasonable control
• Loss or damage resulting from improper use, installation, or maintenance of any product purchased from HomelyVend

HomelyVend's total liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount paid by you for the relevant order.

In the event of any dispute, claim, or complaint arising out of or in connection with these Terms or your use of our services, both parties agree to first attempt to resolve the matter amicably through direct negotiation.

If the dispute is not resolved within fourteen (14) days of written notice by either party, the matter shall be referred to mediation before a mutually agreed mediator in Lagos, Nigeria. If mediation fails, either party may then pursue legal remedies available under Nigerian law.

Your personal information is collected and processed in accordance with our Privacy Policy, available on our website. By using our services, you consent to the collection and use of your data as described therein. HomelyVend is committed to complying with the Nigeria Data Protection Regulation (NDPR) and all applicable data protection laws.

HomelyVend reserves the right to suspend or permanently terminate your access to our website and services, without prior notice, if you breach any provision of these Terms or engage in conduct that we reasonably determine to be harmful to HomelyVend or its customers. Termination shall not affect any rights or obligations that arose prior to the date of termination.

HomelyVend shall not be liable for any failure or delay in the performance of our obligations where such failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, flooding, fire, government action or restrictions, strikes, civil unrest, power outages, or failure of third-party service providers. Our obligations will be suspended for the duration of such event.

HomelyVend reserves the right to update or amend these Terms at any time. Any changes will be posted on this page with an updated "Last Updated" date. Where changes are material, we will make reasonable efforts to notify customers via email or a notice on our website. Your continued use of our website following the posting of changes constitutes your acceptance of the revised Terms.

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. The parties submit to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
